PRACTICAL CLARIFICATIONS ON THE INNOVATIONS PROVIDED FOR BY LAW No. 3926-ИХ,

On April 15, 2025, a large-scale explanatory seminar was held, organized by the Public Council under the State Customs Service of Ukraine together with the State Customs Service of Ukraine and the Ministry of Finance of Ukraine.

The topic aroused great interest among customs specialists, brokers, business representatives and foreign economic entities. For more than three hours, participants received practical explanations on the innovations provided for by Law No. 3926-ИХ, as well as answers to the most pressing questions.

We sincerely thank the representatives of the State Customs Service and the Ministry of Finance for the high levelpreparation, openness to dialogue and thorough analytics!

• The Institute of Customs Representation: Direct and Indirect Representation, Obligations and Risks;

• New Approaches to Authorization of Customs Brokerage Activities;

• Transitional Period, Compliance Criteria, Application Submission Mechanism;

• Practical Aspects of Entering Data into the Customs Declaration (Box 44, Code 1001).

Key Takeaways from the Seminar:

• Permits for Authorized Customs Brokerage Activities are issued 5 to 10 days after consideration of the application.

• Work experience is currently not required to obtain a permit.

• An application form has been developed and will be published on the website of the Ministry of Finance.

• Before submitting an application, it is necessary to fill out a self-assessment questionnaire.

• There is a permanent commission of 8 people that will consider applications as they are received.

• There is no appeal procedure in case of refusal.

• Permission can only be obtained if all criteria are met.

• The State Customs Service uses a single system that reflects possible violations of customs legislation by the applicant.

• Individual entrepreneurs submit applications on a general basis.

Regarding “direct” and “indirect” mediation:

• It is advisable to change the contract, but for now it is enough to indicate in column 44:

• 1 – independent declaration

• 2 – direct mediation

• 3 – indirect mediation

The seminar was only the first in a series of planned events.
