Can Law Enforcement Fine Drivers for Speeding Using Smart Tacho 2 Data?

The Polish Ministry of Infrastructure is developing a new system of fines for traffic violations recorded by cameras (CANARD) and speed monitoring systems.
Starting January 1, 2028, liability could be shifted directly to vehicle owners.
What changes for carriers?
A new obligation will be introduced: upon receiving a notification, the company must identify the offending driver within 30 days and obtain their signature acknowledging acceptance or refusal of the fine.
If the driver cannot be identified or their signature obtained, the fleet operator faces an administrative fine ranging from 1,500 to 7,500 PLN (approximately €348–€1,742).
The situation is complicated by the fact that fines often arrive months later, by which time the employee may have already quit, retired, or left the country.
